A special greeting to the attendees at the recent Collections Institute hosted by the International Foundation of Employee Benefit Plans.  I was invited to speak on the topic:  "Recent Collection Cases--You be the Judge."  My presentation was offered in quiz form, where the audience members were expected to try their hands at predicting how recent court decisions resolved particular issues.  To take the quiz yourself, follow this link.  One note of caution, however, is that you will have to record your answers and tally your score yourself.  I was not able to set this up to automatically record your quiz answers.  At the end, you can see how you did by comparing your answers with those of the courts.  If you can wait a few weeks until I get the materials from the Foundation, I will put up the results of the attendees.  If you can wait even longer, I will post an article that includes an explanation of each of the answers.--Paul Green

Mooney, Green, Baker & Saindon, P.C. was established to serve the interests of working people by assisting their labor representatives and benefit plans. The Firm represents unions in the private and public sectors, and in many industries and fields, including mining and industrial, service employees, educational, transportation and construction.  Services provided to unions range from litigation (including cases involving offensive and defensive RICO and anti-trust actions, defending injunction and strike damage suits, and defending member law suits), assisting unions in responding to governmental investigations and audits, assisting in collective bargaining, and advising on such matters as regulatory compliance, internal union affairs, organizing, and strike conduct. The Firm also represents pension and benefit plans of all sizes. Services to these plans include tax qualification, ERISA compliance, employer collection actions, responding to governmental investigations, obtaining rulings and exemptions from the appropriate governmental agencies, defending participant law suits, and general advice.  The Firm has also been involved in crafting legislation to address labor issues that could not be adequately resolved in collective bargaining.

The Firm represents its clients at every level of the court system, all the way up to the Supreme Court.  The Firm's Supreme Court practice has included its success in such cases as Eastern Associated Coal Corporation v. United Mine Workers of America, No. 99-1038, as well as  its participation in Eastern Enterprises v. Apfel, No. 97-42, Barnhart v. Sigmon Coal Co., No. 00-1307, and Barnhart v. Peabody Coal Co., Nos. 01-705 and 01-715.

MARK J. MURPHY

Mr. Murphy’s practice is significantly devoted to advising unions in both the private and public sector on a wide array of labor and employment issues. Mr. Murphy also has significant experience in representing the Firm’s clients in arbitration proceedings, including challenges to Employer imposed discipline upon bargaining unit members.

Mr. Murphy provides advice and representation to clients seeking to organize unrepresented workers. Such advice includes handling matters before both the National Labor Relations Board and the Public Employee Relations Board of Washington, D.C., as well as providing guidance on organizing and representational issues under the Congressional Accountability Act. Mr. Murphy has also appeared before the Office of Employee Appeals in cases involving reductions in force (“RIFs”) imposed by the District of Columbia Public Schools.

In addition, Mr. Murphy advises the Firm’s clients concerning compliance with a variety of federal labor laws, including issues relating to the collection of union dues and agency fees. Mr. Murphy has successfully defended clients against duty of fair representation claims. He has also been extensively involved in federal litigation in a number of courts throughout the country seeking to protect retiree health care in the coal industry. Mr. Murphy has defended the Firm’s clients in complex federal RICO and state defamation cases. Finally, Mr. Murphy represents individuals in discrimination cases and cases brought under the Fair Labor Standards Act.

Mr. Murphy is admitted to practice law in the state of Maryland and the District of Columbia. He is also admitted to practice in the United States Court of Appeals for the District of Columbia Circuit, the United States Court of Appeals for the Third Circuit, the United States Court of Appeals for the Fourth Circuit, the United States Court of Appeals for the Sixth Circuit, the United States Court of Appeals for the Seventh Circuit, the United States District Court for the District of Columbia and the United States District Court for the District of Maryland.
